Terms of Service

1. Agreement to Terms

By booking a yacht charter with Azimut 68S Charter Piran ("we," "our," or "us"), you agree to be bound by these Terms of Service. Please read these terms carefully before making a reservation. If you do not agree to these terms, you should not proceed with your booking.

2. Booking and Payment

Day Charters:

  • 50% deposit required to confirm booking
  • 50% balance due 7 days before departure
  • Security deposit: €2,000 (refundable, held on credit card)

Weekly Charters:

  • 30% deposit required to confirm booking
  • 70% balance due 30 days before departure
  • Security deposit: €5,000 (refundable, held on credit card)

All payments must be made by bank transfer or credit card. Your booking is not confirmed until we receive your deposit payment.

3. Cancellation Policy

By the Client:

  • More than 30 days before departure: 50% refund of total charter fee
  • 15-30 days before departure: 25% refund of total charter fee
  • Less than 15 days before departure: No refund

By Us (Weather/Safety):

If we cancel due to unsafe weather conditions or mechanical issues, you will receive a full refund or the option to reschedule without penalty. The captain's decision regarding weather conditions and safety is final.

4. Security Deposit

A refundable security deposit is required and will be held on your credit card. The deposit will be refunded within 7 days after the charter, provided there is no damage to the yacht or equipment. Any damages, excessive cleaning required, or missing items will be deducted from the security deposit.

5. What's Included

  • Professional captain and all crew costs
  • Fuel for standard itineraries
  • Marina fees at home port (Piran)
  • Yacht insurance
  • Basic safety equipment and water toys (paddleboards, snorkeling gear)
  • Bed linens and towels (weekly charters)

6. What's NOT Included

  • Food and beverages (bring your own or purchase our drink packages)
  • Marina fees at other ports (if applicable)
  • National park entrance fees
  • Additional activities (jet skiing, diving, etc.)
  • Onboard chef/hostess (available as add-on)
  • Tips for crew (discretionary, typically 10-15%)

7. Guest Responsibilities

As a charter guest, you agree to:

  • Provide valid identification for all passengers (passport or ID required for border crossings)
  • Follow all safety instructions from the captain and crew
  • Treat the yacht and equipment with care
  • Not engage in illegal activities onboard
  • Comply with all maritime regulations and local laws
  • Not exceed maximum passenger capacity (10 guests for day charters, 6 guests overnight for weekly charters)
  • Be sober and capable of following safety instructions

8. Captain's Authority

The captain has absolute authority regarding all matters relating to the navigation, safety, and operation of the yacht. The captain may alter or cancel any itinerary due to weather, sea conditions, mechanical issues, or safety concerns. The captain's decisions are final and made in the best interest of guest safety.

9. Itinerary Changes

While we strive to follow the planned itinerary, routes may be adjusted based on weather conditions, sea state, port availability, and border formalities. We reserve the right to modify the itinerary at any time for safety or operational reasons. No refunds will be provided for itinerary changes made for safety reasons.

10. Liability and Insurance

The yacht is fully insured for third-party liability. However, we strongly recommend that all guests obtain comprehensive travel insurance covering medical expenses, trip cancellation, and personal belongings. We are not liable for personal injury, loss, or damage to personal property unless caused by our negligence. Guests participate in water activities at their own risk.

11. Force Majeure

We are not liable for any failure to perform our obligations due to circumstances beyond our control, including but not limited to: extreme weather, natural disasters, strikes, government restrictions, pandemics, or mechanical breakdowns not caused by negligence.

12. Smoking and Pets

Smoking is only permitted on the outdoor decks. Pets are not allowed onboard unless prior written permission has been obtained.

13. Governing Law

These Terms of Service are governed by the laws of Slovenia. Any disputes arising from these terms or your charter shall be subject to the exclusive jurisdiction of the courts of Slovenia.

14. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on our website with an updated "Last updated" date. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.
